Terms of Service

These terms are a contract between you and DINKSO, an unincorporated undertaking based in Hong Kong (“DINKSO”, “we”, “us”). By creating an account or using the app you agree to them. If you do not agree, please do not use DINKSO.

How we handle your personal data is set out separately in our Privacy Policy, which forms part of these terms.

DINKSO is a community platform for pickleball players. It lets you create a PlayerCard, find and join clubs and sessions, organise your own, and share your card publicly.

We are a platform, not an organiser. Clubs, sessions, leagues, venues and coaching listed on DINKSO are created and run by users, not by us. We do not verify the accuracy of listings, the suitability of a venue, the qualifications of a coach, or the identity or conduct of any player, except where a listing is explicitly marked as verified by us.

You must be at least 13 years old to hold an account. If you are under 18, you may only use DINKSO with the consent and supervision of a parent or guardian, who accepts these terms on your behalf. You must have the legal capacity to enter into this contract.

Keep your sign-in method secure — anyone with access to your email or linked Google/Apple account can access your DINKSO account. You are responsible for activity under your account. Tell us promptly at hello@dinkso.app if you believe it has been compromised.

Provide accurate information. In particular, do not misstate your DUPR rating or falsely present yourself as a verified coach — other players rely on this when choosing sessions.

You keep ownership of everything you upload — your photos, bio, club and session descriptions. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, resize and display that content for the purpose of operating and promoting DINKSO. This licence ends when you delete the content or your account, except for copies already shared by others or retained in backups for a limited period.

Only upload content you have the right to use. Do not upload photos of other people without their agreement.

Note on sharing: when you share your PlayerCard, it generates a public link that anyone holding it can open without signing in. Treat a shared card as published.

You agree not to:

• harass, threaten, abuse or discriminate against other players;
• impersonate anyone, or misrepresent your affiliation with a club or venue;
• post content that is unlawful, obscene, or infringes someone else’s rights;
• create fake accounts, sessions, or clubs, or manipulate ratings or waitlists;
• scrape, bulk-download, or automate access to the service;
• attempt to bypass rate limits, access controls, or security measures;
• use DINKSO for unrelated commercial solicitation or spam.

We may remove content or suspend accounts that breach these terms. Where it is reasonable to do so we will tell you why.

Pickleball is a physical activity carrying a risk of injury. Sessions arranged through DINKSO are organised by other users and take place entirely at your own risk.

You are responsible for deciding whether you are fit to play, for your own equipment, and for your own insurance. You are meeting people you may not know, at venues we do not control and have not inspected. Take the same precautions you would with any meeting arranged online.

To the fullest extent permitted by law, we are not liable for injury, illness, death, loss or damage to property arising from your participation in any session, league, or coaching arranged through DINKSO, or from your interactions with other users. Nothing in these terms excludes liability for death or personal injury caused by our own negligence, or for fraud, where such exclusion is not permitted by Hong Kong law.

Session fees.Any fee for a session is set by, and paid directly to, the organiser — currently outside the app (for example cash or FPS on the day). DINKSO records a payment status for the organiser’s convenience only. We are not a party to that payment, do not hold the money, and cannot issue refunds. Disputes about session fees are between you and the organiser.

Subscriptions. Paid subscription features for club organisers are [NOT YET AVAILABLE — UPDATE BEFORE LAUNCHING BILLING]. When introduced, pricing, billing cycle, cancellation and refund terms will be presented before you subscribe and will form part of these terms.

We aim to keep DINKSO running but do not guarantee uninterrupted or error-free service. We may change, suspend or discontinue features, and may need to take the service down for maintenance. We will give notice of significant changes where we reasonably can.

You may stop using DINKSO and request deletion at any time by contacting hello@dinkso.app. We may suspend or terminate an account that materially breaches these terms, or where required by law. Sections that by their nature should survive termination — including sections 5, 7, 11 and 13 — will do so.

DINKSO is provided “as is”. To the fullest extent permitted by law we exclude implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We are not liable for indirect or consequential loss, or for loss of profit, data, or opportunity.

These limits do not apply to liability that cannot lawfully be excluded under Hong Kong law, including under the Control of Exemption Clauses Ordinance (Cap. 71).

We may update these terms. For material changes we will notify you in the app before they take effect. Continuing to use DINKSO after that means you accept the updated terms.

These terms are governed by the laws of the Hong Kong Special Administrative Region, and you and we submit to the exclusive jurisdiction of the Hong Kong courts.

本條款是您與 DINKSO（位於香港、未有註冊成立法人的營運單位，下稱「DINKSO」、 「我們」）之間的合約。當您建立帳戶或使用本應用程式，即表示同意本條款。 如不同意，請勿使用 DINKSO。

我們如何處理您的個人資料，另載於我們的私隱政策， 該政策構成本條款的一部分。

DINKSO 是匹克球（Pickleball）球員的社群平台，讓您建立 PlayerCard、尋找及參加 球會和球局、自行籌辦活動，以及公開分享您的球員卡。

我們是平台，並非主辦者。DINKSO 上列出的球會、球局、聯賽、場地 及教練均由用戶建立及營運，並非由我們營運。除非某項內容明確標示為經我們核實， 否則我們不會核實其準確性、場地是否合適、教練資歷，或任何球員的身份或行為。

您須年滿 13 歲方可持有帳戶。如您未滿 18 歲，只可在家長或監護人 同意及監督下使用 DINKSO，並由其代您接受本條款。您須具備訂立本合約的法律行為能力。

請妥善保管您的登入方式 — 任何能存取您電郵或已連結的 Google／Apple 帳戶的人， 均可存取您的 DINKSO 帳戶。您須為帳戶下的活動負責。如懷疑帳戶被盜用，請盡快 電郵至 hello@dinkso.app 通知我們。

請提供準確資料。特別是不得虛報 DUPR 評分，或訛稱自己是經核實的教練 — 其他球員會依賴這些資料選擇球局。

您上載的一切內容（相片、簡介、球會及球局描述）的擁有權仍屬於您。您授予我們 非獨家、全球性、免版稅的授權，以寄存、儲存、調整尺寸及展示該等內容，用於營運 及推廣 DINKSO。當您刪除內容或帳戶時，此授權即告終止，惟他人已分享的副本或 備份中短期保留的副本除外。

請只上載您有權使用的內容。未經他人同意，請勿上載其相片。

分享須知：當您分享 PlayerCard 時會產生公開連結，任何持有該連結 的人無需登入亦可開啟。請將已分享的球員卡視為已公開發布。

您同意不會：

• 騷擾、威脅、辱罵或歧視其他球員；
• 冒充他人，或虛報您與球會或場地的關係；
• 發布違法、猥褻或侵犯他人權利的內容；
• 建立虛假帳戶、球局或球會，或操縱評分及候補名單；
• 抓取、大量下載或以自動化方式存取本服務；
• 嘗試繞過流量限制、存取控制或保安措施；
• 將 DINKSO 用於無關的商業招攬或濫發訊息。

我們可移除違反本條款的內容或暫停有關帳戶。在合理情況下，我們會告知原因。

匹克球屬體力活動，存在受傷風險。透過 DINKSO 安排的球局由其他用戶籌辦， 您參與時風險完全自負。

您須自行判斷身體是否適合參與、自備裝備並自行安排保險。您將與可能素未謀面的人 會面，地點亦非由我們控制或視察。請採取與任何網上安排會面相同的預防措施。

在法律允許的最大範圍內，就您參與透過 DINKSO 安排的任何球局、聯賽或教練課堂， 或與其他用戶互動而引致的受傷、疾病、死亡、損失或財物損毀，我們概不負責。 惟就因我們自身疏忽導致的死亡或人身傷害，或欺詐行為，凡香港法律不容許免責者， 本條款概不排除有關責任。

球局費用。球局費用由主辦者訂定並直接支付予主辦者 — 目前於應用程式外進行（例如當日以現金或轉數快支付）。DINKSO 記錄付款狀態 只為方便主辦者。我們並非該筆付款的一方，不會持有款項，亦無法退款。 有關球局費用的爭議屬您與主辦者之間的事宜。

訂閱。球會主辦者的付費訂閱功能[尚未推出 — 開始收費前須更新]。推出時，價格、收費週期、取消及退款條款會在您訂閱前 清楚列明，並構成本條款的一部分。

我們致力維持 DINKSO 運作，但不保證服務不會中斷或完全無誤。我們可能更改、暫停或 終止個別功能，亦可能需要暫停服務進行維護。在合理可行的情況下，我們會就重大改動 發出通知。

您可隨時停止使用 DINKSO，並電郵至 hello@dinkso.app 要求刪除帳戶。 如帳戶重大違反本條款，或法律有所要求，我們可暫停或終止該帳戶。按其性質應於 終止後繼續有效的條款（包括第 5、7、11 及 13 條）將繼續有效。

DINKSO 按「現狀」提供。在法律允許的最大範圍內，我們不作任何關於適銷性、 特定用途適用性及不侵權的隱含保證。

我們不就間接或後果性損失，或利潤、資料或機會的損失負責。

上述限制不適用於香港法律（包括《管制免責條款條例》第 71 章）不容許免除的責任。

我們可能更新本條款。就重大修訂，我們會在生效前於應用程式內通知您。 在該等修訂生效後繼續使用 DINKSO，即表示您接受更新後的條款。

本條款受中華人民共和國香港特別行政區法律管轄，您與我們均服從香港法院的專屬司法管轄權。
